JOB TITLE: Information Governance Officer - BREXIT
LOCATION: Remotely based / in Wandsworth when safe to return to the office
PAY RATE: £200 PAYE / £258 Umbrella per day
DURATION: 3 months minimum
IR35 STATUS: Inside

Temporary resource is required to work with the Information Governance Team, and other Departments (eg Procurement) as appropriate, to address the implications for the flow of personal data in the event of a No Deal Brexit; Brexit with a Deal but no Adequacy Decision from the EU; and the recent ECJ decision on Schrems11.

Main tasks are likely to include:

Review of current guidance from Central Government (specific guidance for local government from the MHCLG attached), the ICO and the European Data Protection Board (EDPB) (in particular the EDPB are currently reviewing Standard contractual Conditions) in relation to Brexit and the recent ECJ decision on Schrems11.

Based on that review, we're seeking someone to develop an initial work plan to meet the three key steps set out in the MHCLG guidance, (more detail on which is in the Guidance itself) and include:

  • Conduct an audit of personal data processing in the SSA, where the data is received from or sent to a third party.

  • Identify the SSA's data flows from the EU/ EEA to the UK, and where we need to put in place alternative arrangements to allow data flows to continue in a 'no adequacy' scenario, identify the action that would need to be taken.

  • Identify data stored by EEA processors, for example cloud storage providers (eg Microsoft) based in the EU and take appropriate action.

  • Revisit the exercise which was undertaken in 2019 to establish any issues re a NDB for our main providers/suppliers. Each was contacted seeking reassurance about Brexit preparedness and business continuity. There was a specific reference asking suppliers to identify any specific issues in relation to data flows.

  • Review existing ROPAs, Data Sharing Agreements , DPIAs etc to establish changes needed in event of a NDB or Brexit with a deal but no Adequacy Decision from the EU and the impact of Schrems11 in relation to data flows to the USA.

  • Draft appropriate amendments to Privacy Notices, DSAs, DPIAs and contracts.
